Article 12 – Fixed-Term and Indefinite-Term Contracts: Duration, Termination and Renewal
Termination
- The consumer may terminate an indefinite-term contract for the regular supply of products or services at any time, subject to a maximum notice period of one month.
- The consumer may also terminate a fixed-term contract for the regular supply of products or services at the end of the agreed term, subject to a maximum notice period of one month.
- The consumer may always:
- terminate the contract at any time;
- use the same method of termination as was used to enter into the contract;
- benefit from the same notice period as that applied by Mayford London.
Renewal
- A fixed-term contract may not be automatically extended or renewed, except in the following cases:
- subscriptions to newspapers or magazines may be automatically renewed for a maximum period of three months, with the option to terminate subject to one month’s notice;
- contracts automatically renewed for an indefinite period may be terminated by the consumer at any time with a maximum notice period of one month (or three months if delivery takes place less than once per month).
- Trial or introductory subscriptions will automatically end upon expiry of the agreed period.
Duration
- Where a contract is concluded for a period exceeding one year, the consumer may terminate it at any time after one year, subject to a maximum notice period of one month, unless the principles of good faith and fairness prevent this.
Article 13 – Payment
- Unless otherwise agreed, amounts owed by the consumer must be paid within 7 business days from the beginning of the withdrawal period referred to in Article 6. For services, this period begins upon confirmation of the contract.
- The consumer must immediately report any errors in the payment information provided or recorded.
- In the event of non-payment, Mayford London is entitled to charge the consumer reasonable collection costs as permitted by law.
Article 14 – Complaints Procedure
- Any complaint concerning the performance of the contract must be submitted to Mayford Londonin writing, in full and with clear reasons, within 7 days of discovering the issue.
- Mayford London will respond to the complaint within 14 days of receiving it. If additional time is required, the consumer will receive an acknowledgement of receipt within the same 14-day period, including an indication of the expected processing time.
- If the dispute cannot be resolved amicably, it may be submitted to the applicable dispute resolution procedure.
- Submitting a complaint does not suspend the consumer’s obligations unless Mayford London agrees otherwise in writing.
- If a complaint is found to be justified, Mayford London will, at its discretion, repair or replace the product free of charge.
Article 15 – Applicable Law and Disputes
These General Terms and Conditions, as well as all contracts concluded between Mayford London and the consumer, are exclusively governed by Dutch law, even if the consumer resides abroad.
Article 16 – CESOP
In accordance with European measures applicable since 2024 concerning the implementation of the Central Electronic System of Payment Information (CESOP) and payment services legislation, payment service providers may be required to record certain information relating to cross-border payments in the European CESOP system.
